Government response to UK statutory regulations consultation

The Government has published its response to the consultation on the proposed changes to the statutory scheme to control the cost of branded health service medicines. The new regulations will come into force on 1 April 2018.

The statutory scheme will be aligned more closely with the current voluntary PPRS, replacing the 15% price cut from the NHS maximum list price with a repayment mechanism, which will be set at 7.8% of net sales from the specified presentation.

As set out in the original consultation, exemptions to the new statutory regulations include extant framework and contract agreements, low presentations (<£2) and companies with sales <£5m.
